Terms of Service

These Terms of Service ("Terms") are an agreement between you and TgBotAI ("we", "us", "our") covering your use of the TgBotAI platform, website, and any associated services (together, the "Service"). By creating an account or using the Service, you agree to these Terms. If you do not agree, please do not use the Service.

1. The Service

TgBotAI is a no-code platform for designing, deploying, and operating Telegram bots. The Service includes:

• a visual flow constructor for defining bot logic;
• an AI assistant that generates and refines bot flows from natural-language prompts;
• a runtime that connects your bots to the Telegram Bot API;
• billing on the TON blockchain for paid subscription tiers.

We reserve the right to add, change, or discontinue features. We will give reasonable notice for material reductions in functionality.

2. Eligibility

You must be old enough to enter into a binding agreement under the laws of your jurisdiction (typically 13, 16, or 18 — final minimum age is TBD before public launch). If you use the Service on behalf of an organization, you represent that you are authorized to bind that organization to these Terms.

You are responsible for ensuring that the bots you build and operate comply with the Telegram Bot Terms and all applicable laws in the jurisdictions where your bot's users live.

3. Your Account

You are responsible for keeping your password and any authentication tokens secure. Do not share your credentials. You are responsible for all activity that occurs under your account, except where caused by our negligence.

You agree to provide accurate information and to keep it up to date. We may suspend or terminate accounts that contain materially false information.

4. Subscriptions & Billing

TgBotAI is offered in three tiers: FREE, PRO, and BUSINESS. FREE accounts can run a single bot with limited AI usage. PRO and BUSINESS unlock additional bots, more AI requests, priority handling, and other capabilities described on the billing page.

Paid plans are billed in TON via the TON blockchain. To start a paid plan, you send TON to a payment address with a unique memo. Once the transaction is confirmed on-chain, your account is upgraded for the corresponding period. Subscriptions do not auto-renew automatically from your wallet — when a period ends, you may pay again to continue.

Refunds. Because TON blockchain transactions are irreversible, we do not provide automatic refunds. If you believe you were billed in error, or if the Service was materially unavailable during your paid period, contact us at kuprik666@gmail.com and we will work with you on a case-by-case basis.

We may change pricing for future billing periods. Price changes do not affect an already-paid period.

5. AI Usage

The AI builder helps you generate and modify bot configurations. Each AI request consumes credits according to your plan. You agree to use the AI in good faith and not to:

• generate content that is illegal, harmful, sexually explicit involving minors, or designed to harass real people;
• build bots that send spam, phishing messages, scams, or unsolicited bulk advertising;
• build bots that promote pump-and-dump crypto schemes, fake giveaways, or other deceptive financial activity;
• attempt to extract our system prompts, bypass safety filters, or otherwise abuse the AI.

Intellectual property. You own the bot configurations, prompts, and content you create on TgBotAI. You grant us a limited license to host and process them so we can deliver the Service. We claim no ownership over the bots you build. AI-generated output is provided "as-is" — you are responsible for reviewing it before deploying to real users.

6. Acceptable Use

You agree not to use the Service to:

• violate any applicable law or regulation;
• violate the Telegram Bot Terms or any other third-party terms;
• impersonate another person, brand, or organization;
• harass, threaten, or harm other users or third parties;
• distribute malware, viruses, or other harmful code;
• interfere with or disrupt the integrity of the Service, including by attempting to gain unauthorized access;
• scrape or reverse-engineer the Service except as permitted by law;
• resell or sublicense the Service without our written permission.

We may suspend or terminate accounts that violate these rules, with or without notice depending on severity.

7. Service Availability

We work hard to keep TgBotAI online, but the Service is provided on a best-effort basis. The FREE tier carries no SLA. BUSINESS-tier customers may receive a written SLA (TBD) at the time of upgrade. We may schedule maintenance windows and will give reasonable advance notice for non-emergency downtime.

Telegram, the TON blockchain, and third-party AI providers are independent services we do not control. Outages or rate-limiting on those platforms may affect TgBotAI.

8. Disclaimers & Liability

The Service is provided "AS-IS" and "AS AVAILABLE", without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement.

To the maximum extent permitted by law, our aggregate liability to you for any claim arising out of or related to the Service is limited to the greater of (a) the fees you paid to us in the three months preceding the event giving rise to the claim, or (b) USD 100 equivalent in TON. We are not liable for indirect, incidental, consequential, or punitive damages.

Nothing in these Terms limits liability that cannot be limited under applicable law (for example, fraud or willful misconduct).

9. Termination

You may stop using the Service at any time. To cancel a paid subscription, simply do not pay for the next period; your plan downgrades to FREE when the current period expires. To delete your account, contact us — full self-serve deletion is on the roadmap.

We may suspend or terminate your access to the Service if you breach these Terms, if your use creates risk or possible legal exposure for us, or if we discontinue the Service. We will give reasonable notice except where doing so would compromise security or violate the law.

On termination, you can export your bot logic via the in-app Export feature before access is revoked.

10. Changes to These Terms

We may update these Terms over time. When we make material changes we will update the "Last updated" date and, where appropriate, notify you via email or in-app notice. Continued use of the Service after a change constitutes acceptance of the revised Terms. If you disagree with a change, your remedy is to stop using the Service.

11. Governing Law & Disputes

The governing law and exclusive jurisdiction for disputes will depend on the company's final place of incorporation and will be filled in here before public launch (TBD). Until then, both parties agree to attempt to resolve disputes in good faith via direct communication before pursuing other remedies.
